Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Mama iOS application (the "App"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Mama App ("we," "our," or "us") governing your use of the App. We may update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

Mama is a daily affirmations application designed for mothers. The App delivers affirmation content, allows you to save favorites, and offers customizable visual themes. No account registration is required to use the App.

3. Subscriptions & In-App Purchases

Certain features of the App are available through an auto-renewing subscription purchased via Apple's In-App Purchase system ("IAP"). By initiating a subscription, you agree to the following:

• Billing. Your subscription will be charged to your Apple ID account at the price confirmed at the time of purchase. Billing occurs at the start of each subscription period.
• Auto-Renewal. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Managing & Cancelling. You can manage or cancel your subscription at any time through your device's App Store settings: Settings → [Your Name] → Subscriptions. Cancellation takes effect at the end of the current billing period — you will retain access until that date.
• Refunds. All purchases are processed by Apple. Refund requests must be submitted to Apple directly through their standard refund process. We have no ability to issue refunds.
• Price Changes. We reserve the right to change subscription pricing. Apple will notify you of any price increase before it takes effect and will require your consent to continue.

Your use of IAP is also subject to Apple's Media Services Terms and Conditions.

4. Intellectual Property

All content within the App — including affirmation text, illustrations, graphics, design, and code — is the exclusive property of Mama App or its licensors and is protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use only. You may not copy, modify, distribute, sell, sublicense, or create derivative works from any part of the App or its content without our prior written permission.

5. Acceptable Use

You agree not to use the App in any way that:

• Violates any applicable local, state, national, or international law or regulation
• Attempts to reverse-engineer, decompile, or extract the source code of the App
• Interferes with or disrupts the integrity of the App or any connected Apple services
• Is used for any commercial purpose without our express written consent

6. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Affirmation content is provided for general wellness and motivational purposes only and is not a substitute for professional mental health advice, diagnosis, or treatment.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Mama App and its owners, officers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App — even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

8. Termination

We reserve the right to discontinue the App or any part of it at any time, with or without notice. Upon termination, your right to use the App ceases immediately. Sections 4, 6, 7, and 9 survive termination.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the state in which Mama App is registered, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.

10. Apple's Role

The App is distributed through Apple's App Store. Apple is not a party to these Terms and has no obligation to provide any maintenance or support for the App. In the event of any third-party claim that the App infringes intellectual property rights, Apple is not responsible for investigation or defense of such claims. Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce these Terms against you as a third-party beneficiary.

11. Changes to These Terms

We may revise these Terms at any time. When we do, we will update the effective date above. Continued use of the App after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
